THE MINISTRY OF TRADE ISSUES TWO NEW EXPORT REGULATIONS; CAN FREEPORT EXPORT Copper Again?

Two new laws from Kemendag aim to boost Indonesia's exports. Permendag No.22/2023 and No.23/2023 annul Minister of Finance Regulation Number 26 of 2022 on Goods Classification System and Exemption of Import Duty Tariffs on Imported Goods, effective July 19, 2023. The amendments attempt to simplify export restrictions and satisfy company, ministry, and technical institution concerns. The new regulations regulate mining product exports, extend export relaxation for forestry/timber industry products, and allow some mining product concentrate exports. Permendag Number 23 demands a self-declaration and removes masks from the prohibited item list.PT Freeport Indonesia, which received a revised Permendag, received concentrate export licenses from the government. The new Permendag should take effect in 7 days. Under Law No. 3/2020 on Mineral and Coal Mining (Minerba), the government has banned copper concentrate exports. Exports are allowed until the smelter opens in 2024.
