NEW IMPORT REGULATION CREATES HEADACHES FOR DOMESTIC BUSINESSES

Various domestic industries are raising concerns with the implementation of Minister of Trade (MoT) Regulation No 36/2023 on Import Policy and Regulation, as revised by MoT Regulation No 3/2024. The regulation, which introduces substantial changes to import policies and arrangements, became effective on 10 March 2024. Businesses across sectors are facing difficulties complying with the new rules, leading to concerns about hampering exports, increasing production costs, and disrupting retail operations. The Indonesian Footwear Association (APRISINDO) on Thursday (21/3) noted the lack of transparency in the quota calculation process for import. The system is unclear and subject to government discretion, adding to uncertainties and making it difficult to plan for the future. Shoe manufacturers are facing difficulties securing fabrics and other raw materials due to import restrictions, causing disruptions in the supply chain and jeopardizing their ability to meet seasonal demands ahead of the Eid Al Fitr celebration. Moreover, a complex procedure involving government recommendations is now required to import product samples, hindering their ability to showcase their products competitively for export orders. Importing product samples, like other products, are now subject to import restriction and limitation at the border. Separately, the Indonesian Packaging Federation (IPF) has complained about the lack of harmonisation within the regulation's HS Codes for imported raw materials, which has caused difficulties in imports. IPF notes that these would lead to increased production costs for packaged goods, which will ultimately be passed on to consumers. The regulation is not just impacting manufacturers, but also the retail sector, especially those dealing with imported branded goods. The Indonesian Retailer and Tenant Association (HIPPINDO) reports that the new rules require retailers to undergo lengthy verification and audit processes, leading to delays in receiving products and causing stock shortages. This could not only disrupt their business but also threaten the livelihoods of smaller retailers that rely heavily on imported goods.
