Law on public procurement adopted in KazakhstanPresident of Kazakhstan Kassym-Jomart Tokayev signed the law “On Public Procurement” and its accompanying laws, the press service of the head of state reported.The law is aimed at optimizing procurement procedures, improving the quality of purchased goods, works and services, strengthening the responsibility of government procurement participants and developing competition.The first block of amendments to the law is aimed at simplifying and shortening procurement procedures. The complaint review mechanism has been updated, and the role of the Ministry of Finance as a supervisory authority has been revised. In order to promptly conduct procurement, provide greater powers to customers, and also avoid delaying procurement procedures, complaints will now be considered directly by the procurement organizer himself.In order to expedite the acquisition by customers of goods, works and services and provide them with greater independence, the right to purchase from single source of goods up to 100 MCI, works and services up to 500 MCI is provided. The possibility of purchasing from a single source of goods, works and services necessary to prevent emergency situations has also been established.In addition, the procurement procedure for scientific organizations has been simplified.The second block of amendments to the law is aimed at improving the quality of purchased goods, works and services. To improve the qualifications of procurement participants and develop non-price criteria for selecting a supplier, a register of potential suppliers has been introduced.Information about the supplier will be generated through the widespread use of data from information systems of government agencies (work experience, financial stability, absence of tax debts, posting financial statements in the public domain, etc.).The third block of amendments to the law is aimed at strengthening the responsibility of suppliers. Thus, the possibility of public monitoring of government procurement has been introduced. A ban has been established on the participation in public procurement of a potential supplier, manager or founder who has previously committed corruption offences. The maximum volumes of work and services transferred by the supplier to subcontractors (co-contractors) to perform work or provide services have been reduced from 50% to 30%.The fourth block of amendments to the law is aimed at developing competition. The law establishes the possibility of transferring all state and quasi-state organizations to a single procurement platform - the government procurement web portal.The method of purchasing through commodity exchanges is excluded. Single source procurement through direct contracting with a specific supplier identified by the government will now be carried out in exceptional cases when it is necessary for the implementation of critical facilities and projects of national importance.In order to support domestic producers, the Ministry of Finance will approve a separate list of industrial and industrial goods, which will be purchased exclusively from small and medium-sized businesses.The law comes into force on January 1, 2025.In addition, the President signed the accompanying laws “On amendments and additions to some legislative acts of the Republic of Kazakhstan on procurement issues and revision of legislative acts for unnecessary (excessive) legislative regulation of norms” and “On amendments to the Code of the Republic of Kazakhstan on Administrative Offenses.” (ICE ALMATY)
