Responsibility for use of others' EDS tightened in KazakhstanResponsibility for using another person's electronic digital signature (EDS) has been tightened in Kazakhstan, increasing the period of administrative liability and the amount of the fine, according to the Ministry of Digital Development, Innovation and Aerospace Industry (MDIAI).The new regulations came into force on March 13, 2025.The period of administrative liability for committing administrative offences in the area of personal data protection has been increased from two months to one year.The Ministry also increased the amount of the fine for violating the legislation on personal data and its protection: from 10-1000 to 30-2000 MCI, depending on the of the constituent elements of offence and the category of the business entity. In addition: administrative liability will be applied for the use of an EDS by another person."Previously, administrative liability was only applied for the illegal transfer of the EDS key to third parties and the failure of the holder of the registration certificate to take measures to protect it. After the amendments come into force, both the person who transferred the EDS and the person who used it will be held liable," the department's press service added.Managers are advised to sign reports themselves, which guarantees compliance with the principle of personal responsibility when using EDS.An individual or sole trader may also notarise a power of attorney to sign an electronic document for an accountant or other authorised person. In this case, each person must use an EDS received in his or her name."Individuals and legal entities are required to take measures to protect their digital signatures from unauthorised access and use. Failure to take appropriate measures will result in administrative liability," the statement said. (ICE ALMATY)
