AMENDMENT TO PUBLIC PROCUREMENT LAW IN FAVOUR OF POLISH COMPANIES

On Tuesday, May 27, the government adopted an amendment to the Public Procurement Law, thus implementing the judgment of the Court of Justice of the EU in the Kolin case (C-652/22). It stipulates that contractors from third countries may not compete for access to public contracts on the EU market on the same terms as contractors from the European Union and countries that have signed the GPA agreement. They are also not entitled to possible legal remedies, and admission or not to participate in a particular proceeding is decided on a case-by-case basis by the contracting authority. The government boasts that the new solution is revolutionary - for the first time in history, the possibility of closing the Polish public procurement market is introduced, and the adopted regulations will promote restoring the importance of Polish capital in the economy.
