EU APPEALS ‘INTO THE VOID’ WTO RULING ON INDONESIA BIODIESEL EXPORTS
The European Union has decided to appeal a World Trade Organization (WTO) ruling that invalidated its countervailing duties on Indonesian biodiesel, despite the WTO's Appellate Body being non-functional. This move effectively places the case in limbo. Indonesia expressed regret over the appeal and noted that alternative arbitration options were available, which the EU had previously proposed. The EU has imposed duties ranging from 8% to 18% on Indonesian biodiesel since 2019, citing unfair subsidies and below-market access to raw materials. Indonesia’s Trade Ministry is currently evaluating its response to the EU’s decision. Before the duties were implemented, the EU was Indonesia’s second-largest palm oil export destination, now ranking third.
