Digital Code adopted in KazakhstanPresident of Kazakhstan Kassym-Jomart Tokayev has signed the Republic's Digital Codex, the presidential press service reported on Friday.The purpose of the Digital Code is to create a unified, transparent, and effective system of legal regulation for the digital sphere in Kazakhstan.The Code consists of six sections, 19 chapters, and contains the following main innovations: legislative consolidation of digital human rights,; establishment of the right of a digital environment subject to review decisions made using algorithmic systems; legal regulation of the use of biometric data and biometric authentication, stipulating that mandatory processing of biometric data and conducting biometric authentication are permitted exclusively in cases provided for by the laws of Kazakhstan.Furthermore, the code specifies and enshrines the legal status of digital objects, including digital records, digital assets, digital resources, digital platforms, software, digital systems, digital infrastructure objects, and digital data products.A separate chapter of the code regulates the lifecycle of digital government objects, including the stages of planning, creation, pilot operation, cybersecurity compliance testing, commissioning for industrial operation, development, modification, archiving, and decommissioning.The President also signed an accompanying law on Digitalization, Transport, and Entrepreneurship. The amendments are systemic and clarifying in nature, aimed at ensuring uniform application of legislative norms.Overall, the accompanying document introduces institutions for calculating and suspending the timeframes for providing public services. Telecommunications operators are assigned obligations to implement internal anti-fraud systems, as well as to block unauthorized traffic for the purpose of detecting and preventing cyber threats and ensuring compliance with cybersecurity requirements. The law also provides for the establishment of an authorized organization to investigate aviation accidents.The Head of State also signed a second accompanying law on Administrative Offenses. The amendments introduce employer liability for failure to submit, untimely submission, or submission of inaccurate information to the unified system for recording employment contracts, and improve the application of automatic recording of offenses.
