INDONESIA'S E‑COMMERCE RULES DO NOT OVERLAP WITH MSME MINISTRY POLICIES
Indonesia’s Minister of Trade, Budi Santoso, confirmed that the ongoing revision of Minister of Trade Regulation (Permendag) No. 31 of 2023 on the e‑commerce and marketplace ecosystem will not overlap with regulations currently being prepared by the Ministry of Micro, Small and Medium Enterprises (MSMEs). He emphasized that close coordination between ministries has been maintained from the outset to ensure the rules complement one another. While details of the revision have not yet been disclosed, the updated regulation aims to strengthen consumer protection, prioritize local and MSME products, and ensure fair promotion and sales practices on e‑commerce platforms. The revised regulation is being discussed with all relevant stakeholders, including digital platforms and sellers, to create a mutually beneficial and balanced e‑commerce ecosystem. In parallel, the Ministry of MSMEs is drafting specific rules on e‑commerce administrative fees in response to widespread complaints from MSMEs about high commissions and logistics costs imposed by platforms.
